Terms of Service

1. Agreeing to these terms

By creating an account or using WheelingTrips, you agree to these terms and to our Privacy Policy. If you don't agree, don't use the service.

You need to be at least 13 years old to use WheelingTrips. If you're using the service on behalf of a club, business, or organization, you confirm you have the authority to agree on its behalf.

2. What WheelingTrips is

WheelingTrips is a service operated by Lithium Holdings, LLC, an Iowa limited liability company, doing business as WheelingTrips ("Lithium Holdings," "we," "us"). When these terms refer to "WheelingTrips" they refer to the service; legal obligations are owed to and by Lithium Holdings, LLC.

WheelingTrips is a trip-planning tool for overlanders and road-trippers. You can map routes, break them into segments, invite buddies, calculate fuel cost estimates, and export GPX files for in-vehicle navigation apps.

It is a planning tool, not a real-time navigation system. Trail conditions, weather, road closures, fuel availability, and cellular coverage in the backcountry are all your responsibility to verify before and during a trip. We do our best with the data we get from third-party services, but we can't promise it's complete or current.

3. Your account

You are responsible for your account. That means:

• Keep your password private and use a strong one. Turn on two-factor authentication if you can.
• Anything that happens under your account is on you. If you suspect someone else has access, change your password and email legal@lithiumholdingsllc.com right away.
• Use real, accurate information when you sign up. Don't impersonate someone else.
• One person per account. Don't share logins.

4. Acceptable use

Don't use WheelingTrips to:

• Harass, threaten, dox, or abuse another user, including buddies on shared trips.
• Do anything illegal, including planning trips that involve trespass on private land you don't have permission to be on.
• Scrape, crawl, or reverse-engineer the service. The API isn't open to the public.
• Resell access, white-label the service, or run it for a paying third party without a separate written agreement.
• Probe, attack, or interfere with the service or with other users' accounts.

We may suspend or close an account that violates these rules. For clear or repeated violations we'll do it immediately.

5. Subscriptions, payment, and refunds

The Lone Wolf is free, with the limits described on the pricing page. The Overlander is a paid subscription billed monthly or annually.

Payments are processed by an external payment processor. We don't see or store your credit card number. By subscribing, you also agree to the payment processor's terms.

Refund policy:

• No refunds on past billing periods. If you cancel mid-month or mid-year, you keep paid-plan access until the end of the period you already paid for. You won't be charged again.
• Downgrades are prorated at renewal, not mid-cycle.
• Cancel anytime from the Billing page in your account.

We can change pricing for future billing periods. If we do, we'll email you before it takes effect so you can cancel if you don't like the new price.

6. Your content

Trips, waypoints, vehicle profiles, gear lists, and other content you create on WheelingTrips belong to you. You retain copyright in your content.

When you invite a buddy or generate a public share link, you're authorizing us to show the relevant trip data to those people. When you revoke a share link or remove a buddy, their access ends.

License for uploaded media

When you upload photos or other media to WheelingTrips, you grant Lithium Holdings, LLC (dba WheelingTrips) a perpetual, non-exclusive, worldwide, royalty-free license to use, store, copy, modify, display, and distribute that media for the following purposes:

• Operating and improving the service. Including running it for you and your buddies, testing, debugging, building new features, and training internal systems.
• Marketing WheelingTrips. Including on the public website, social media, app stores, and printed promotional materials.

You keep your copyright. This license is non-exclusive, so you can still do whatever you want with your own photos. Sell prints, post them yourself, license them to a magazine, anything.

Revoking the license

You can revoke this license for media you have uploaded by sending a written request to legal@lithiumholdingsllc.com from the email address on your account, identifying the specific media you want covered. Once we process the revocation, we'll stop using the named media for the purposes described above and will fully delete it from our storage within thirty days. Revocation applies prospectively. It doesn't unwind copies of the media already distributed (for example, marketing posts already published on third-party platforms).

Privacy commitments when we use uploaded media

When we use your uploaded photos for marketing, we protect the privacy of the people in them:

• We don't publicly attribute photos to you by name without your consent.
• We crop, blur, or otherwise obscure identifying details (license plates, residential addresses, recognizable faces of bystanders) where doing so is reasonable for the surface.
• If you want a specific photo excluded from any marketing use, email legal@lithiumholdingsllc.com with enough detail to identify it and we'll honor the request.

Removed and deleted media

If you or the trip planner removes a photo, or if a trip is deleted, the photo is detached from that trip but is not deleted from our systems. Detached media remains available to WheelingTrips for the license uses described above, but is no longer linked to a specific trip or visible to other users. If you want a detached photo fully deleted from our systems, email legal@lithiumholdingsllc.com from the email address on your account and we'll honor the deletion.

7. Ending your account

You can delete your account at any time from your account settings, or by emailing legal@lithiumholdingsllc.com. We'll remove your trips and personal data on the schedule described in the Privacy Policy.

We may suspend or close your account if you violate these terms, if we're legally required to, or if your account has been inactive long enough that we need to reclaim the storage.

8. Disclaimers. Read this one

WheelingTrips is provided "as is" and "as available." We do not warrant that the service will be uninterrupted, error-free, secure, or that any specific data (routes, mileage, fuel estimates, weather, trail status) will be accurate.

You are responsible for the safety of your trip. That includes the condition of your vehicle, fuel and water planning, navigation in places without cell coverage, trail closures, permit requirements, weather, and your own driving. WheelingTrips is a planning aid. It is not a replacement for paper maps, your own judgment, or telling someone where you're going before you leave.

9. Limitation of liability

To the maximum extent allowed by law, Lithium Holdings, LLC (dba WheelingTrips) and its owners, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the service.

Our total liability for any claim related to the service is capped at the greater of (a) the amount you paid us in the twelve months before the claim, or (b) one hundred US dollars.

10. Changes to these terms

We may update these terms as the service changes. If we make a change that materially affects your rights, we'll let you know by email or with a notice in the app at least a week before the change takes effect. Continuing to use WheelingTrips after that point counts as accepting the new terms.

11. Governing law

These terms are governed by the laws of the State of Iowa, USA, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Iowa.
